It is important that you have an indicative offer of finance prior to finalising your structures, as the selection of lender can have a bearing on the structure used or the fine detail of the wording of Trust Deeds.
I Already Have My SMSF
If you already have your SMSF established, it is prudent to undertake the following prior to making offers on property:
Conduct a review of the SMSF to ensure that your rules facilitate borrowing
Establish the Trustee for your Bare Trust as this will be the entity entering into the Contract of Sale. You cannot actually establish the Bare Trust until you have details of the property that you will be purchasing – but you can have everything in readiness once the property is selected (generally following “offer and acceptance”).
I Don't Have My SMSF Yet It is definitely advisable that you have your SMSF Trust and Trustee and the Trustee for your Bare Trust established prior to entering into property negotiations. Failing to do so is very likely to affect your ability to have everything in order to settle on the property in time.
Failing to get this right can often lead to stressful situations and, worst case, lost opportunities , penalty interest or loss of deposit monies.
